  1. Acceptance of Terms

These Terms and Conditions of Sale and Website Use (“Terms”) govern your access to and use of the website located at BioBoostLabsLLC.com (the “Site”) and all related products, services, communications, transactions, accounts, and interactions provided by BioBoost Labs+™ (“BioBoost Labs+™,” “Company,” “we,” “us,” or “our”) (collectively, the “Services”).

By accessing the Site, creating an account, placing an order, or otherwise using the Services, you (“Customer,” “User,” or “Purchaser”) acknowledge that you have read, understood, and agree to be legally bound by:

  • these Terms and Conditions;
  • our Privacy Policy; and
  • all policies incorporated herein by reference.

If you do not agree, you must immediately discontinue use of the Services.

BioBoost Labs+™ may update these Terms periodically. Continued use of the Services following publication of revised Terms constitutes acceptance of such updates.

  1. Nature of Business and Supplier Status

BioBoost Labs+™ operates solely as a supplier of laboratory research materials.

BioBoost Labs+™:

  • is not a medical provider;
  • is not a licensed pharmacy;
  • is not a compounding pharmacy under Section 503A of the Federal Food, Drug, and Cosmetic Act;
  • is not an outsourcing facility under Section 503B of the Federal Food, Drug, and Cosmetic Act.

All products are supplied exclusively as laboratory research chemicals.

  1. Eligibility Requirements

Use of the Services and purchase of products is restricted to individuals who:

  • are at least twenty-one (21) years of age; and
  • possess legal capacity to enter binding agreements.

By using the Services or placing an order, you represent and warrant that you satisfy these requirements.

  1. Research Use Only — Mandatory Condition of Sale

ALL products sold by BioBoost Labs+™ are intended strictly for:

  • laboratory research,
  • analytical testing,
  • scientific investigation, or
  • educational purposes.

Products are expressly:

  • NOT intended for human or animal consumption;
  • NOT intended for therapeutic, diagnostic, cosmetic, or medical use;
  • NOT approved by the U.S. Food and Drug Administration to diagnose, treat, cure, or prevent any disease.

Purchase, receipt, or possession constitutes acknowledgment of these restrictions.

  1. Purchaser Certification and Scientific Competency

By placing an order, Customer represents and certifies that:

  • products are purchased solely for lawful research purposes;
  • Customer possesses appropriate scientific knowledge and laboratory capability;
  • products will be handled using proper laboratory safety procedures;
  • all applicable laws and regulations will be followed.

BioBoost Labs+™ relies upon these certifications as a material condition of sale.

  1. Intended Use Compliance and Prohibited Conduct

Customer agrees products shall not be:

  • administered to humans or animals;
  • used as drugs, supplements, or performance-enhancing substances;
  • marketed or represented for therapeutic or medical purposes;
  • relabeled or redistributed for prohibited use.

BioBoost Labs+™ reserves the right to refuse service, cancel orders, or terminate accounts where misuse is suspected.

  1. Account Registration and Security

Users are responsible for maintaining accurate account information and safeguarding login credentials.

You are responsible for all activities conducted under your account.

BioBoost Labs+™ may suspend or terminate accounts involved in fraud, misuse, or violation of these Terms.

  1. Order Acceptance and Right to Refuse Service

Submission of an order does not constitute acceptance.

BioBoost Labs+™ reserves the right to:

  • refuse or cancel orders,
  • limit purchase quantities,
  • delay shipment,
  • restrict accounts,

for compliance, fraud prevention, operational security, payment authorization, or inventory reasons.

  1. Pricing, Taxes, and Payment Authorization

All prices are listed in U.S. Dollars unless otherwise stated.

Customer authorizes BioBoost Labs+™ and its payment processors to charge submitted payment methods for all applicable amounts.

Orders may undergo automated fraud screening.

  1. Transfer of Title and Risk of Loss

Title and risk of loss transfer to Customer upon delivery of products to the shipping carrier.

BioBoost Labs+™ is not responsible for:

  • carrier delays,
  • shipping damage,
  • customs actions,
  • delivery refusal,
  • loss or theft after dispatch.
  1. Shipping Compliance Responsibility

Customer bears sole responsibility for determining legality of purchase, importation, possession, and use within their jurisdiction.

BioBoost Labs+™ assumes no responsibility for regulatory seizure or customs action.

  1. Refunds, Returns, and Cancellations

Due to the sensitive nature of research materials:

All sales are final.

Orders may be canceled only prior to shipment.

Approved cancellations:

  • may be refunded via Venmo, PayPal, or designated method;
  • are subject to a 15% processing fee;
  • are processed within approximately 5–7 business days.
  1. Chargebacks and Payment Disputes

Customer agrees to contact BioBoost Labs+™ prior to initiating payment disputes.

Fraudulent or bad-faith chargebacks constitute breach of these Terms.

BioBoost Labs+™ reserves the right to recover associated losses, fees, and legal costs.

  1. Assumption of Risk

Customer acknowledges research chemicals may possess unknown biological or toxicological properties.

Customer voluntarily assumes all risks associated with possession, handling, experimentation, storage, transport, and disposal.

  1. No Medical or Professional Advice

Information provided by BioBoost Labs+™ is informational only and does not constitute medical, legal, or scientific advice.

  1. Automated Systems and Communications

BioBoost Labs+™ utilizes automated systems for:

  • order processing,
  • fraud detection,
  • logistics management,
  • analytics,
  • electronic communications.

Operational actions may occur without manual review.

  1. Intellectual Property

All Site content, trademarks, branding, and materials are exclusive property of BioBoost Labs+™ and may not be reproduced without written permission.

  1. Operational Security and Facility Confidentiality

BioBoost Labs+™ maintains confidential operational and fulfillment locations for safety and security purposes.

Physical locations are not publicly disclosed.

  1. Limitation of Liability

To the fullest extent permitted by law, BioBoost Labs+™ shall not be liable for indirect, incidental, consequential, or punitive damages.

Customer’s exclusive remedy shall be limited to:

  • the amount paid within the preceding twelve (12) months; or
  • USD $100, whichever is greater.

These remedies constitute Customer’s sole and exclusive remedies.

  1. Indemnification

Customer agrees to defend, indemnify, and hold harmless BioBoost Labs+™ from claims arising from misuse, unlawful handling, or violation of these Terms.

  1. Electronic Agreement

Electronic acceptance constitutes legally binding agreement under the U.S. ESIGN Act and UETA.

Transaction records may serve as evidence of agreement.

  1. Express Research Chemical Acknowledgment and Waiver

Customer expressly acknowledges that products may possess unknown risks and are supplied solely for lawful laboratory research.

Customer assumes full responsibility for all outcomes arising from possession or use and knowingly waives claims arising from misuse or non-research application to the fullest extent permitted by law.

  1. Binding Arbitration Agreement

All disputes shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association under applicable commercial rules.

Arbitration shall occur within the State of Texas, unless otherwise required by law.

Both parties waive the right to jury trial.

  1. Class Action Waiver

All disputes must be brought individually and not as part of any class or representative action.

  1. Force Majeure

BioBoost Labs+™ shall not be liable for delays caused by events beyond reasonable control including natural disasters, governmental action, infrastructure failure, or supply disruptions.

  1. Severability and Survival

Invalid provisions shall not affect enforceability of remaining Terms.

  1. Entire Agreement

These Terms together with the Privacy Policy constitute the entire agreement between Customer and BioBoost Labs+™.

  1. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States.
